However, it is possible to file your own divorce in Hawaii for no more than the state divorce form filing fees. This page provides all of the forms you need to initiate your do-it-yourself divorce in Hawaii.
First, you have to select which island you live on since forms are slightly different for each island. The island choices are Oahu, Hawaii, Kauai, and Maui, Molokai or Lanai (3 islands have the same exact Divorce forms). Next you have to fill out the Complaint for Divorce form so that you can start the Divorce. Now your spouse must fill out the Summons to Answer Complaint for Divorce form to answer your Divorce complaint.
The next form to be filled out will be the Matrimonial Action Information form which is used by the Court to get important information on the couple. Also if on the island of Oahu and you have children under 18 years of age you must fill out the Notice to Attend Kids First and attend the program. More information is on the form on page 2 of http://www.courts.state.hi.us/docs/form/oahu/1FE787.pdf. You can then apply for forms to be served to you through the mail though that is optional.
Next fill out the Income and Expense Statement form together with your spouse so that the Court is aware of the income and expenses of you and your spouse. In addition, an Asset and Debt Statement must be filled out by both parties so that the Court is aware of all of you and your spouse’s assets and debts. If you do not want to have to have to appear in Court for your Divorce hearing you can sign an Appearance and Waiver form but remember it is optional. The next form to be filled out is the Affidavit of Plaintiff which is necessary for the Court to make sure you are giving them correct information. The last form that must be filed is the Divorce Decree form. Filling out and filing this form is necessary to obtain a judgment from the Court and for all the issues mentioned in the entire Divorce process to be dealt with once and for all.
